Professional Document Preparation at Your Direction
Santa Clara Eviction provides professional clerical document-preparation services for customers who have already decided how they want to proceed or who are acting on instructions from an attorney, mediator, or authorized self-help resource. Our goal is to prepare clear, organized paperwork that reflects the information and instructions you provide.
Although unlawful detainer document preparation is a central part of our work, we also prepare documents in a range of other California matters. We are not attorneys, do not provide legal advice, do not select legal forms for customers, and do not represent customers in court.

Unlawful Detainer Document Preparation
For landlords who have determined the procedure they want to use, Santa Clara Eviction can prepare unlawful detainer paperwork at the customer’s specific direction. Depending on the stage of the matter and the instructions provided, this may include notices, summons and complaint documents, proofs of service, default-related paperwork, judgment documents, writ-related paperwork, and other ministerial filing documents.
Eviction law is highly procedural, and local rent or eviction rules may affect a particular property. If you need advice about which notice to use, whether a tenancy may legally be terminated, possible defenses, strategy, or what you should say in court, consult a licensed attorney or an authorized court self-help resource before directing us to prepare the paperwork.

Divorce and Legal Separation
When a customer has selected the documents to be prepared, we can provide clerical assistance with divorce and legal-separation paperwork, including petitions, responses, summons documents, financial disclosures, and other family-law forms identified by the customer or an authorized source.
We prepare the documents from the information and instructions provided to us. Questions about property rights, support, custody strategy, characterization of assets or debts, settlement terms, or other legal consequences should be directed to a licensed attorney or an appropriate self-help resource.

Child Custody and Visitation
We can prepare custody and visitation documents when the customer has decided what orders or parenting schedule to request. This may include Requests for Order, declarations containing the customer’s own facts and instructions, proposed parenting schedules, responsive paperwork, and related forms selected by the customer or an authorized source.
We do not decide what custody arrangement is best, predict how a judge will rule, or advise a customer what position to take. Those questions require legal advice.

Child and Spousal Support
Accurate financial information is important in support proceedings. At the customer’s direction, we can prepare Income and Expense Declarations, support-related requests and responses, attachments, and other identified forms using the figures and information supplied by the customer.
We do not calculate what a customer should request as a legal position, determine which income should legally be included or excluded, or advise whether support should be ordered. Customers who need those determinations should consult an attorney or authorized self-help resource.

Revocable Living Trust Documents
For customers who have already determined the estate-planning documents and terms they want, we can provide clerical preparation of revocable living trust documents and related paperwork at their specific direction. Where directed, related documents may include a pour-over will, powers of attorney, healthcare documents, and transfer documents identified by the customer or an authorized source.
Estate planning can have important tax, property, creditor, family, and inheritance consequences. We do not recommend an estate plan or advise whether a trust is appropriate for a particular person.

Wills and Estate Planning Documents
We can prepare wills and other estate-planning documents from the customer’s specific instructions when the customer has selected the documents and decided the terms. The customer remains responsible for the legal decisions reflected in those documents.
If you need advice about beneficiaries, disinheritance, tax consequences, incapacity planning, trust provisions, community property, or the effect of a particular estate-planning choice, consult a licensed attorney.

Probate and Guardianship Document Preparation
At the customer’s direction, we can prepare identified probate and guardianship documents, including petitions, notices, inventories, reports, orders, and related forms selected by the customer or an authorized source. We can also assist with clerical organization of supporting information and exhibits.
Probate and guardianship proceedings can involve competing rights, statutory priorities, fiduciary duties, objections, and court hearings. We do not advise who should file, whether a petition should be contested, or what legal position a customer should take.

Civil Litigation Document Support
For self-represented litigants who have selected the documents they need, we can prepare civil pleadings and other identified paperwork at their specific direction. This may include complaints, answers, declarations, motions, oppositions, discovery documents, and supporting forms when the customer supplies the substance and instructions.
We do not evaluate claims, select causes of action, recommend discovery strategy, determine legal defenses, research a customer’s legal position as part of LDA services, or appear in court.

Small Claims and Collection Documents
We can prepare small-claims and post-judgment collection documents that the customer has selected, using the customer’s instructions and information. Depending on the matter, customers may direct preparation of claims, responses, abstracts, or other identified enforcement paperwork.
We do not advise whether a debt is collectible, which enforcement method a customer should choose, whether property is exempt, or how a customer should litigate the matter.

Notary Public, Process Service, and Real Estate Documents
Santa Clara Eviction also provides Notary Public and registered process-server services. Notarial services are separate from Legal Document Assistant services, and notarization does not constitute legal advice or approval of a document’s legal effect.
At a customer’s specific direction, we can also prepare identified real-estate documents such as grant deeds, quitclaim deeds, and other ministerial documents when the customer has already determined the document and terms to use. We do not advise which deed should be used, how title should be held, or the legal or tax consequences of a transfer.
